Dear Gamazing:

I am writing on behalf of Atari, Inc./Atari Interactive, Inc. (“Atari”), which is one of the world’s most-recognized and leading interactive entertainment software companies.  Atari is a global producer, publisher and distributor of interactive entertainment software for all market segments and all interactive game platforms.

I am reaching out to you in regards to your App located at https://play.google.com/store/apps/details?id=com.Gamazing.SpaceEscape which makes use of Atari’s trademarked name ‘Asteroids’. In view of this fact, we request that you change the name of your application to avoid consumer confusion.

If you are unable to confirm that you understand and will comply with these demands we will take the necessary steps to remove your application and ability to sell on Google Play indefinitely.

If you have any questions or wish to discuss this matter further, please contact the Atari IP Enforcement Team:  AtariIPEnforcement@newmo.com.

Thank you.

Regards,

Atari IP Enforcement Team

@newmo.com ??? I replied that they have to give more information about being valid as the real Atari, because to me this looks fake. Why would they even bother with an app only having 2k downloads?

Anyways what do you guys think?

Hey Nick, it could be real. I once got a notice from atari about not being allowed to use the 'Pong' name in one of our games.
Atari has been purchased by several companies and so it could now belong to newmo.com. I believe Atari has changed company hands a few times. Companies usually purchase it because they have a famous name and the rights to games like Pong, Asteroids etc. I don't think the original Atari company exists anymore and so that's why the email is coming from newmo.com.
So in my opinion it's best to change the name. I think the Asteroids search phrase is already super popular in google play anyway and so you might not be ranking very high for it. You can just add it in the description maybe and say something like "players who love classic games like asteroids will love this game too". Or just use the word asteroids more in your description.

hope this helps, let us know how it goes.

I believe its real andI had the following to say back...

Quote:
I have no issue changing the name, but honestly, how can a tittle like "RetroCraft: Asteroid Calamity" be in conflict with Atari's "Asteroid's".
Does Atari have the right to enforce these laws on anyone who has asteroid or any Space related words in there tittle... I beleive its a bit to much... I would like a replie please...

We will see how this one goes...

Just quickly googled and newmo.com is a brand protection company so I would say that it's a legit email. However my guess is they could only do this with automated bots checking for a certain keyword, sending a email and hoping people will change it. I don't think they can actually enforce it as to be honest they would have gone straight to google.

Just my thoughts anyway.

Hey Nick I sent email about which word should I change and they replied to me with this message :

Quote:

Hello,

You are correct, we are asking you to remove the word Asteroid from the title of your app.

Sincerely,

Atari IP Enforcement Team

So I think that this should answer my question but I am still not sure [smile]

Hi guys, yes, I to received an email from them:

Quote:

Hello,

We do not object to the contents of your game or the rest of the game title beyond the use of ‘Asteroids’. However when consumers search for Atari’s Asteroids, they are also going to find your Asteroids game, and that’s going to lead to consumer confusion so we are asking your to cease using ‘Asteroids’ as part of your game’s title.

Sincerely,

Atari IP Enforcement Team

Bast***s...
